These Terms of Service ("Terms") govern your use of the Caliber Virtual website and services. By accessing our website or engaging our services, you agree to these Terms.
Services Description
Caliber Virtual provides fully managed virtual assistant staffing services. We recruit, train, and manage dedicated virtual assistants from the Philippines who work exclusively for your business during their scheduled hours. Our services include talent matching, onboarding, ongoing quality management, and replacement guarantees.
Service Engagement
- Services begin after a consultation, mutual agreement on scope, and execution of a service agreement.
- Virtual assistants are contractors managed by Caliber Virtual, not employees of the client.
- We assign a dedicated Customer Success Manager to oversee your engagement.
- Working hours, communication channels, and task scope are established during onboarding.
Payment Terms
- All plans are billed monthly in advance.
- Pricing is as published on our pricing page or as agreed in your service agreement.
- No long-term contracts are required. Plans are month-to-month unless you opt for a term commitment.
- Late payments may result in service suspension after a 5-business-day grace period.
Cancellation
- You may cancel your plan at any time with 15 days written notice.
- Cancellation takes effect at the end of the current billing period.
- No refunds are issued for partial months.
Replacement Guarantee
If your assigned virtual assistant is not the right fit, we will provide a replacement at no additional cost. Replacement requests should be communicated to your Customer Success Manager.
Confidentiality
We execute Non-Disclosure Agreements (NDAs) with all clients. Your business information, processes, and data are treated as confidential. Virtual assistants are bound by confidentiality obligations as part of their engagement with Caliber Virtual.
Data Handling
Data handling practices are governed by our Privacy Policy. For clients in regulated industries (healthcare, finance, legal), we provide additional compliance training and execute industry-specific agreements (e.g., HIPAA Business Associate Agreements).
Limitation of Liability
Caliber Virtual provides managed staffing services on a best-effort basis. We are not liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the fees paid for the month in which the claim arose.
Intellectual Property
All work product created by your virtual assistant during their engagement belongs to you. Caliber Virtual retains no ownership of client work product. Our website content, branding, and proprietary training materials remain the property of Caliber Virtual.
Acceptable Use
You agree not to direct your virtual assistant to engage in activities that are illegal, unethical, or that violate applicable regulations. Caliber Virtual reserves the right to reassign or terminate services if this provision is violated.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to active clients via email. Continued use of our services after changes constitutes acceptance.
Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
